Kejriwal cannot perform official duties if granted bail: Supreme Court

The Supreme Court, while hearing the bail plea of Delhi Chief Minister and AAP leader Arvind Kejriwal challenging his arrest observed that Kejriwal cannot perform any official duties if he is granted bail.

Kejriwal’s case is being heard by a bench comprising of Justice Sanjiv Khanna and Dipankar Dutta. 

“Suppose we release you, and you are allowed to participate in elections, you will be performing official duties…it can have cascading effects…We make it clear, we don’t want you to be performing official duties if we release you,” Justice Sanjiv Khanna said during the hearing.

The Court also observed that Kejriwal is not a habitual offender. “ “He is elected CM of Delhi. There are elections…These are extraordinary circumstances. He’s not a habitual offender,” the Court remarked.

Kejriwal was arrested by the Enforcement Directorate (ED) on March 21 in connection with the money laundering case related to the Delhi Excise Policy. On April 9, the Delhi High Court dismissed the writ petition challenging the arrest of Kejriwal by the ED. Kejriwal then moved the Supreme Court.
