Open Thread | THIS, Once Again, Proves WHY The Court Will ALWAYS Be Important…Decisions Like This

When I say that I will ALWAYS have smoke for those who told us in 2016 that they couldn’t be scared into voting for Hillary ‘ by using the Court’…
I mean it.
They will never ever ever be able to live down what they did in 2016. Because, they are directly responsible for what happened on the Supreme Court. And, the results of what a right-wing, 6-3 court can do.

So, disenfranchising 1.3 million Black people in South Carolina, denying them representation..
One out of every four people in South Carolina..

Uh huh

Supreme Court allows disputed South Carolina voting map, a win for GOP
At issue was whether the map was an unconstitutional attempt to divvy voters up by race — or was permitted partisan gerrymandering.
By Patrick Marley and Ann E. Marimow

The Supreme Court on Thursday allowed the use of a South Carolina congressional map that a lower court said “exiled” thousands of Black voters to carve out a district safer for a White Republican incumbent.

At issue for the court was whether South Carolina’s new map, which was created by the GOP-led state legislature and moved Black voters from one district to another, was permitted to bolster the Republican majority or was an unconstitutional effort to divvy up voters by race. The 6-3 conservative majority sent the case back to the lower court, giving Republicans a victory by finding that it erred when it determined race predominated the map-drawing process.

Writing for the majority, Justice Samuel A. Alito noted many predominantly Black precincts in Charleston were moved out of one district and into another. But “because of the tight correlation between race and partisan preferences, this fact does little to show that race, not politics drove the legislature’s choice,” he wrote.
He was joined by Chief Justice John G. Roberts Jr. and Justices Clarence Thomas, Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett.

Justice Elena Kagan, writing for the justices nominated by Democrats, said the majority got it “seriously wrong.”
“Perhaps most dispiriting is what lies behind the court’s new approach — its special rules to specifically disadvantage suits to remedy race-based redistricting,” Kagan wrote in an opinion joined by Justices Sonia Sotomayor and Ketanji Brown Jackson.

Kagan warned that the majority opinion sends a message to lawmakers and mapmakers to use race as a proxy to achieve partisan ends.

“And so this ‘odious’ practice of sorting citizens, built on racial generalizations and exploiting racial divisions, will continue,” she wrote. “In the electoral sphere especially, where ‘ugly patterns of pervasive racial discrimination’ have so long governed, we should demand better — of ourselves, of our political representatives, and most of all of this Court.”

The case is one of several redistricting cases that has been closely watched because the U.S. House is so narrowly divided. Some of them won’t be conclusively decided until after this year’s elections and will determine districts for 2026 and beyond.

Open Thread | Nancy Pelosi Earned Every Inch of the Presidential Medal of Freedom

Makes the upside down flag at Alito’s home all the more obvious.

Chris Swart (@BwanaChris) posted at 8:11 AM on Fri, May 17, 2024:

The intricacies of this insurrection were orchestrated to buy time for Justice Alito’s intervention. How delightfully Machiavellian. The audacity and ineptitude interwoven in this plot is nothing short of a tragicomic marvel.

Sidney Powell’s latest revelations serve as the punchline to this ludicrous coup attempt. The strategy was to delay the certification, to obstruct the democratic machinery just long enough for a Supreme Court justice to intervene. Yet, their plan failed to anticipate one crucial variable: Nancy Pelosi’s indefatigable resolve.

It’s almost endearing, really, how they believed all contingencies were covered, only to be blindsided by the Speaker of the House, who refused to let democracy be hijacked. @SpeakerPelosi reconvening Congress that very day was an act of defiance, a stark rebuke to the insurrectionists who fancied themselves puppeteers.

In their deluded minds, the scenario was meticulously planned, the players strategically positioned, and the legal cavalry poised to charge in. Yet, like an ineptly written farce, reality proved far less strategic and far more chaotic, with would-be tyrants outsmarted by the very system they sought to subvert.

Powell’s revelations expose not just a plot but a profound miscalculation of their adversaries. They presumed they could circumvent constitutional safeguards with brute force and legal manipulations, but were ultimately thwarted by the resolute will of democratic institutions and their unwavering leaders.

It is a sobering illustration of the lengths to which these individuals were prepared to go, juxtaposed with the steadfast resilience of those who opposed them. Powell’s interview adds a new layer to this sordid narrative, revealing the hubris and folly that characterized the masterminds of this insurrection.

Open Thread | More On The Threat To Body Autonomy

The continued threat to body autonomy:

“Shield laws” are laws that blue states have passed to protect providers and patients from red state laws banning modern, best practices health care for women, including access to abortion medication :

Most recently, a legal fellow from Americans United for Life—one of the nation’s most powerful anti-abortion groups—argues at The Federalist that shield laws are unconstitutional. Guzi He writes that the laws violate the Constitution’s extradition clause and “put the commercial interests of abortionists ahead of the safety of women and girls, not to mention the damage done to long-standing traditions of interstate cooperation.”

The column comes just a few days after Kristi Hamrick, vice president of Students for Life Action, told NBC News, “The attempt by some states to create a little safe haven for abortion will not be successful. I think we will end up in court.” And in Amy Littlefield’s terrific piece about “the abortion pill underground” , law professor Mary Ziegler predicts that anti-choice groups might just pull it off. “I think there’s a real possibility a court is going to say, ‘Well, actually, the banned state can come for you,’” she said.

Commercial interests?

No. Medical privacy. None of your phucking business.

Want to remind you that over a dozen GOP State Attorney Generals wanted the ability to get out of state medical records, and the Federal Government said absolutely not.
Remember, Senator Baby Voice from Alabama was putting forth legislation for nationwide database of pregnant women.
The Orange Menace has already said that he doesn’t have problems with states ‘monitoring women’s pregnancies’.

Open Thread | Orange Menace Puts Price On the Future of the Planet

Thank you, Charles Pierce for such a direct title.

Donald Trump Has Put a Literal Price on the Future of the Planet
He had a bunch of oil executives over to his place and told them not to get too stressed about Biden’s climate policies.

By Charles P. Pierce
PUBLISHED: MAY 10, 2024 10:52 AM EDT

One billion dollars.

For that bargain price, El Caudillo del Mar-a-Lago will sell you this planet and the lives of everyone living on it now, as well as the lives of every generation to come, for as long as there are generations to come…

Basically, the former president* proposed a gentler form of the proposition “Nice planet you have here. Be a shame if anything happened to it.” The difference is that the people he was talking to were making the same offer to the rest of us.

Trump vowed at the dinner to immediately end the Biden administration’s freeze on permits for new liquefied natural gas (LNG) exports—a top priority for the executives, according to three people present. “You’ll get it on the first day,” Trump said, according to the recollection of an attendee. The roughly two dozen executives invited included Mike Sabel, the CEO and founder of Venture Global, and Jack Fusco, the CEO of Cheniere Energy, whose proposed projects would directly benefit from lifting the pause on new LNG exports. Other attendees came from companies including Chevron, Continental Resources, Exxon and Occidental Petroleum, according to an attendance list obtained by The Post.

Trump told the executives that he would start auctioning off more leases for oil drilling in the Gulf of Mexico, a priority that several of the executives raised. He railed against wind power, as The Post previously reported. And he said he would reverse the restrictions on drilling in the Alaskan Arctic. “You’ve been waiting on a permit for five years; you’ll get it on Day 1,” Trump told the executives, according to the recollection of the attendee. At the dinner, Trump also promised that he would scrap Biden’s “mandate” on electric vehicles—mischaracterizing ambitious rules that the Environmental Protection Agency recently finalized, according to people who attended. The rules require automakers to reduce emissions from car tailpipes, but they don’t mandate a particular technology such as EVs. Trump called the rules “ridiculous” in the meeting with donors.
This is not climate denialism. This is deliberate destruction for profit. As we have learned over the past several years, the executives in the extraction industry knew the nature of the damage, and the extent of it, long before the rest of us did, and they lied like tobacco experts about what they knew. That probably is still the case, despite the attention the climate crisis has drawn. They simply don’t care, and they’ve cultivated politicians who either don’t care or are too stupid to know why they should, as the small towns back home get blown across state lines by what appears to be an endless chain of tornadoes. With his predator’s instinct for quid pro quo, the former president* was simply honest enough to name his price.

The money isn’t for the his campaign. It’s for his pockets, because he’s taking every cent that comes into the RNC.
And, yet, this isn’t leading the news everyday.

Open Thread | Unca Clarence Has The Nerve To Be Whining…Man..If You Don’t Take Your Corrupt Self And Go Sit Down!

Can you believe this whining?

Thomas says critics are pushing ‘nastiness’ and calls Washington a ‘hideous place’
The justice has faced criticisms that he accepted luxury trips from a GOP donor without reporting them.

FAIRHOPE, Alabama — Supreme Court Justice Clarence Thomas told attendees at a judicial conference Friday that he and his wife have faced “nastiness” and “lies” over the last several years and decried Washington, D.C., as a “hideous place.”

… Thomas spoke at a conference attended by judges, attorneys and other court personnel in the 11th Circuit Judicial Conference, which hears federal cases from Alabama, Florida and Georgia. He made the comments pushing back on his critics in response to a question about working in a world that seems meanspirited.

“I think there’s challenges to that. We’re in a world and we — certainly my wife and I the last two or three years it’s been — just the nastiness and the lies, it’s just incredible,” Thomas said.

“But you have some choices. You don’t get to prevent people from doing horrible things or saying horrible things. But one you have to understand and accept the fact that they can’t change you unless you permit that,” Thomas said…

Positively absurd.
What lies, Clarence?
That you are bought and paid for stooge?
The text messages from your wife to Mark Meadows on January 6th…those lies?

This morally bankrupt and corrupt Justice whining.
A man married to someone who was up to her eyeballs in the January 6th insurrection.
A man so corrupt that he’s nothing but a
LEAVE PAYMENT ON THE NIGHTSTAND HO.

Open Thread | What Is At Stake In November

Saw the tweet where it said that President Biden had his 150th Judge confirmed. Of that, 100 were women.

I want to remind people that there were those in 2016 who told us that they couldn’t be scared into voting for Hillary by using “The Court”. Of course the feeble-minded thoughts of these people were only focused on the Supreme Court. Of course, I meant The Supreme Court, but also the ENTIRETY OF THE FEDERAL JUDICIARY.

A Federal Judiciary that had more openings than it should have because Mitch McConnell had spent years blocking President Obama from being able to fill open slots in the Judiciary. So, there were all those slots to fill when the Orange Menace won. All those Federalist Society judges, a high number deemed UNQUALIFIED , like that clown Cannon down in Florida, doing her best to throw the documents case.😠😠

The same right-wing judges that they go judge shopping with their flimsy , ridiculous cases.

Open Thread | Georgia Governor Signs Election Changes Into Law…Uh huh…Uh huh

Georgia governor signs election changes into law
The bill signed by Republican Gov. Brian Kemp will implement new rules in the battleground state. less than six months before Election Day.
May 7, 2024, 9:40 PM CDT / Source: The Associated Press
By The Associated Press

ATLANTA — Gov. Brian Kemp signed legislation Tuesday that makes additional changes to Georgia’s election laws ahead of the 2024 presidential contest in the battleground state, including defining probable causes for removing voters from the rolls when their eligibility is challenged.

Republican activists — fueled by debunked theories of a stolen election — have challenged more than 100,000 voters in the state in recent years. The activists say they are rooting out duplicate records and removing voters who have moved out of state.

The bill Kemp signed into law — SB 189 — lists death, evidence of voting or registering in another jurisdiction, a tax exemption indicating a primary residence elsewhere, or a nonresidential address as probable causes for removing voters from the rolls. Most controversially, it says the National Change of Address list can be considered, though not exclusively.

Supporters have said the probable cause definition would make the challenge process more difficult. Opponents have disputed that, saying the changes would enable more baseless attacks on voters that would overwhelm election administrators and disenfranchise legitimate voters. For example, people sometimes live at a place of business, which would be considered a nonresidential address. Officials with Georgia Secretary of State Brad Raffensperger’s office say there are more reliable types of information, such as driver’s license data, to confirm a voter’s eligibility.

The Georgia bill also allows challenges to be accepted and voters removed from the rolls up until 45 days before an election. That provision in part has prompted the threat of lawsuits from liberal groups because federal law says states and counties can’t make systematic changes to voting rolls within 90 days of a federal election.

The measure also says homeless people must use the county voter registration office as their address instead of where they live. Opponents have said that could make it harder for homeless citizens to cast ballots because their registered polling place might be far away.

Let’s get to the more than 100,000 voters challenged.
I want people to completely understand this.
These people were not at the polls and someone challenged their voter status based on their signature doesn’t match the official signature on the voter rolls.
No, these people were challenged – THOUSANDS AT A TIME, by people who didn’t know them. Based on ‘ just cause’.
It’s one of the most outrageous forms of Voter Suppression.

I also want to point out the fallability of using the NCOA registry. People go to the Post Office and fill out a Change of Address form for whatever reason. You could be leaving for a short time, and want your mail sent to another address. You still live at your address, but for this snapshot of moment in time, you are leaving. They want to use that registry, with notorious holes in it, to be a way of justifying their voter suppression tactic of challenging voters.
